ER-32 <br />1 The language of EC 9.8320(5)(b) does refer to lands beyond the PUD <br />2 boundaries, and requires safe and adequate pedestrian, bicycle and transit <br />3 circulation both within the PUD and "as well as to adjacent and nearby <br />4 residential areas, transit stops * * * provided the city makes findings to <br />5 demonstrate consistency with constitutional requirements. * * Thus while <br />6 the city is not limited in its consideration of whether the PUD satisfies EC <br />7 9.8320(5)(b) to on-site pedestrian and bicycle circulation, it is limited in its <br />8 ability to remedy any deficiencies in off-site circulation and connectivity by the <br />9 portion of the provision that requires the city "to demonstrate consistency with <br />10 constitutional requirements." <br />11 However, Conte is simply mistaken when he argues that the city failed to <br />12 consider off site circulation and connectivity for pedestrians and bicycles along <br />13 the entirety of Oakleigh Lane. The city did consider off-site circulation and <br />14 connectivity and concluded that the PUD meets EC 9.8320(5)(b): <br />15 "With regard to bicycles and pedestrians traveling westward on <br />16 Oakleigh Lane toward transit services on River Road, referral <br />17 comments from Public Works staff state that, for unimproved local <br />18 streets in the River Road area (i.e., streets that lack sidewalks and <br />19 have not been striped to identify dedicated travel lanes), the <br />20 expectation is that pedestrians and bicyclists will share the paved <br />21 surface with vehicles. Additionally, there is a tendency on dead <br />22 end streets such as Oakleigh Lane, for motorists to travel at <br />23 slower, more cautious speeds, because of the perceived <br />24 narrowness of the street. <br />25 "Public works staff confirm that, until such time that property <br />26 owners elect to improve Oakleigh Lane to full city standards <br />27 (including sidewalks), the existing paved surface of Oakleigh Lane <br />28 will continue to adequately provide for vehicle and pedestrian <br />29 traffic, as well as for emergency vehicles and delivery services, <br />30 provided the paved surface is not blocked by parked vehicles. <br />31 <br />Page 32 <br />000081 <br />
