As such, the <br />criterion of this section does not apply. <br />(5) In areas not covered by subsection (4) of this section, the intensification, change <br />of use, or development shall conform with the following applicable standards: <br />(a) Establishment of adequate setback lines to keep structures separated <br />from the Willamette River to protect, maintain, preserve, and enhance <br />the natural, scenic, historic, and recreational qualities of the Willamette <br />Greenway. Setback lines need not apply to water related or water <br />dependent activities as defined in the Oregon Statewide Planning Goals <br />and Guidelines (OAR 660-15-000 et seq.). <br />Findings: A geographical survey and proposed site plan have been provided <br />that display the boundaries of the site and the approximate boundary of the <br />Willamette River Greenway, River Bank, Ordinary High Waterline, and <br />Approximate Floodway Line that clearly indicating the development property <br />is outside the setbacks of Significant Riparian Corridor. <br />(b) Protection of significant fish and wildlife habitats as identified in the <br />Metropolitan Plan Natural Assets and Constraints Working Paper, Sites <br />subsequently determined to be significant by the Oregon Department of <br />Fish and Wildlife shall also be protected. <br />Findings: The Metropolitan Plan Natural Assets and Constraints Working <br />Paper (Working Paper) does not identify any significant fish or wildlife sites on <br />the subject property, but does identify the Willamette River Corridor as an <br />Anadromous Fish River. The Willamette River is designated as an essential <br />Salmon Habitat by the Oregon Department of Fish and Wildlife (ODFW). This <br />project is separated from the River by topographic and vegetated buffer <br />zones. Standard precautions will be taken during construction to prevent <br />erosion and sedimentation from leaving the project site. <br />(c) Protection and enhancement of the natural vegetative fringe along the <br />Willamette River to the maximum extent practicable. <br />Findings: The development proposes to minimize the building footprint to as <br />small as possible given the project design requirements. Buildings are placed <br />primarily on the North and West portions of the development site, leaving the <br />remaining land - approximately 20% of the entire site - open and accessible <br />to the River and Greenway path system. Furthermore, agreements have been <br />established between Oakleigh Meadow LLC and the City of Eugene giving <br />responsibility of landscape and natural vegetation maintenance of the <br />Willamette Greenway -June 14, 2013 Page 16 of 20 Oakleigh Cohousing WG 13-0001 <br />1351 <br />
