6 <br />from the point at which Oakleigh Lane terminates on the property <br />boundary to the eastern property boundary, to accommodate (1) a <br />future hammerhead turnaround to connect to the adjoining property <br />to the north, in the event it further develops, and (2) a bike and <br />pedestrian path to connect to the adjacent park to the east of the <br />property. However, the city approved a temporary emergency <br />hammerhead turnaround that is located entirely on the western <br />portion of the subject property until the property to the north of the <br />subject property is developed and the hammerhead turnaround can <br />be built. <br />"The hearings officer held a hearing on the application and <br />approved it with conditions. Petitioners and others appealed the <br />hearings officer's decision to the planning commission, and the <br />planning commission affirmed the hearings officer's decision." <br />ERpp7-9. <br />B. Preservation of Error. <br />The issue of whether Trautman's Motion to Intervene should be allowed <br />was raised by Intervenor-Respondent Oakleigh Meadows in its Response to <br />Trautman's Motion to Intervene, LUBA Rec pp 814 - 816, and Trautman's <br />Reply to Intervenor's Response to Motion to Intervene, LUBA Rec pp 802 - <br />805. This issue was preserved. <br />2. Standard of Review. <br />In reviewing the final order of LUBA, the Court of Appeals shall reverse <br />or remand if LUBA's order is "unlawful in substance."
