I <br />A. STATEMENT OF THE CASE <br />1. Nature of the Proceeding and Relief Sought. <br />Petitioners Paul Conte and Simon Trautman seek judicial review of the <br />final opinion and order of the Land Use Board of Appeals ("LUBA"), LUBA <br /># 2014-001, dated August 21, 2014. ("LUBA's Opinion"). ER pp 1 - 42; <br />LUBA Rec pp 50 - 92.' LUBA's Opinion remanded the decision of <br />Respondent City of Eugene (the "City") on one assignment of error. This <br />appeal seeks review of LUBA's decision and requests that this court overturn <br />portions of LUBA's Opinion that affirmed the City's decision granting a <br />tentative planned unit development ("PUD"). <br />2. Nature of Order Sought to Be Reviewed. <br />LUBA's Opinion remanded a decision by the City to grant approval for a <br />tentative PUD application. LUBA remanded based on one assignment of error, <br />but denied several other assignments of error. This appeal seeks review of <br />LUBA's decision on several of the denied assignments of error. <br />References to the record developed before LUBA will use the format "LUBA <br />Rec;" references to the record developed before the City will use either "Rec" <br />for the initial Record filed by the City, or "Supp Rec" for the Supplemental <br />Record filed by the City in response to various record objections. <br />OCTOBER 2014 <br />
