Based on these findings, the development will comply with this criterion. <br />(k) All other applicable development standards for features explicitly included in the <br />application except where the applicant has shown that a proposed <br />noncompliance is consistent with the purposes set out in EC 9.8300 Purpose of <br />Planned Unit Development. <br />The applicable development standards for features explicitly included in the application, which <br />have not already been addressed by other PUD approval criteria and related standards, are as <br />follows: EC 9.2750. Residential Zone Development Standards; EC 9.2795 Solar Setback Standards; <br />EC 9.5500 Multiple-Family Standards; EC 9.6105 Bicycle Parking Space Standards; and EC 9.6410 <br />Motor Vehicle Parking Standards. Staff notes that EC 9.6205 Landscape Standards, EC 9.6730 On- <br />site Pedestrian Circulation, and EC 9.6740 Recycling and Garbage Screening standards are <br />referenced within the multiple-family development standards at EC 9.5500. The development <br />complies with many of these standards, as noted below. Where the development does not <br />comply with these standards, as described in greater detail below, the applicant requests a <br />modification ("proposed non-compliance"), which is allowed through the PUD process, if the <br />following P"UD purpose statements are met. <br />EC 9.8300 Purpose of Planned Unit Development. The planned unit development <br />(PUD) provisions are designed to provide a high degree of flexibility in the design of <br />the site and the mix of land uses, potential environmental impacts, and are intended <br />to: <br />(1) Create a sustainable environment that includes: <br />(a) Shared use of services and facilities. <br />(b) A compatible mix of land uses that encourage alternatives to the use of <br />the automobile. <br />(c) A variety of dwelling types that help meet the needs of all income groups <br />in the community. <br />(d) Preservation of existing natural resources and the opportunity to <br />enhance habitat areas. <br />(e) Clustering of residential dwellings to achieve energy and resource <br />conservation while also achieving'the planned density for the site. <br />(2) ' Create comprehensive site plans for geographic areas of sufficient size to <br />provide developments at least equal in quality to those that are achieved <br />through the traditional lot by lot development and that are reasonably <br />compatible with the surrounding area. <br />With regard to EC Table 9.2750 Residential Zone Development-Standards, the development <br />complies with the following: density (below 14 units per net acre); building height (below 30 feet); <br />interior yard setback (from the east property line only); and the maximum 50 percent lot <br />coverage. The development does not comply with the front yard setback or the interior yard <br />setback (along the south and west property lines). <br />The substandard front yard setbacks are due to the right-o.f-way dedications being required; refer <br />Staff Report: Oakleigh Meadows Cohousing September 2013 Page 27 <br />1014 HO Agenda - Page 34 <br />
