22 <br />EC 9.8320(5)(a) and EC 9.6820(4), EC 9.6870 and Table EC 9.6870 to the <br />2 entirety of Oakleigh Lane from the development site to River Road. <br />3 Subassignment of Error I.C. The Decision did not properly evaluate the <br />4 requirements of EC 9.8320(5)(b) with respect to Oakleigh Lane. <br />5 EC 9.8320(5) requires the proposed PUD to provide "safe and adequate" <br />6 transportation systems through compliance with the following subsection: <br />7 EC 9.8320(5)(b) Pedestrian, bicycle and transit circulation, including <br />8 related facilities, as needed among buildings and related uses on the <br />9 development site, as well as to adjacent and nearby residential areas, transit <br />10 stops, neighborhood activity centers, office parks, and industrial parks, <br />11 provided the city makes findings to demonstrate consistency with <br />12 constitutional requirements. "Nearby" means uses within 1/4 mile that can <br />13 reasonably be expected to be used by pedestrians, and uses within 2 miles <br />14 that can reasonably be expected to be used by bicyclists. <br />15 As legislative context, this requirement is directly supported by Metro Plan <br />16 Policy F.26, which and requires the City to: <br />17 "Provide for a pedestrian environment that is well integrated with adjacent <br />18 land uses and is designed to enhance the safety, comfort, and convenience <br />19 of walking." (Metro Plan at III-F-9) <br />20 Policy F.26 implements OAR 660-012-0045(3) whose "purposes * * * are to <br />21 provide for safe and convenient pedestrian, bicycle and vehicular circulation <br />22 consistent with * * * the function of affected streets * * Rec 235-236. <br />23 Accordingly, EC 9.8320(5)(b) cannot be limited to just the segment of <br />24 Oakleigh Lane abutting the PUD because Oakleigh Lane's function depends on <br />
