Trautman or a representative of the applicant you <br />may not testify (either in writing or orally) but may attend and observe the public hearing. <br />How to Submit Testimony <br />Mr. Trautman may attend the public hearing and state his concerns, or he may send a written statement <br />to the Planning Commission, c/o Gabe Flock, via e-mail: ga riel.flock@ci.eugene.or.us, or mail or hand <br />deliver such written statement to: Gabe Flock, City of Eugene Planning Division, 99 West 10th Avenue, <br />Eugene, Oregon 97401, so long as the City receives the written statement prior to the date set for the <br />hearing. <br />Please note that failure to raise an issue at the hearing, in person or by letter, or failure to provide <br />statements with sufficient specificity to enable the decision maker to respond to the issue, precludes further <br />appeal based on that issue. <br />Conduct of Public Hearin <br />This hearing is not the first evidentiary hearing; the order of procedure is as follows: <br />1. Planning Commission Chair will commence public hearing. <br />2. Planning Commission chair will ask commissioners to disclose any conflicts of interest, ex parte contacts, <br />and biases, abstentions or challenges to impartiality submitted pursuant to EC 9.7065. <br />3. Planning Commission will receive the City staff report. <br />4. Testimony from proponent/applicant. <br />5. Testimony from Mr. Trautman <br />6. Staff response to testimony, if any. <br />7. Questions from the Planning Commission. <br />8. Rebuttal by the proponent/applicant. <br />9. Planning Commission Chair will close the public hearing. <br />Appeal Rights <br />The decision of the Eugene Planning Commission will be final at the local level. Persons who appeared before <br />the local government orally or in writing may appeal the decision to the Oregon Land Use Board of Appeals <br />within 21 days of the Planning Commission's decision.
