Conditions of PUD and CUP approval: <br />Prior to final PUD approval, the applicant shall provide documentation that a certified letter <br />has been has been mailed to property owners at 2070, 2044, 2064 and 2070 Law Lane and the <br />owner of the Northgreen Apartments. The letter shall provide a brief summary noting why the <br />landowner is receiving the letter and that the intent of the optional plantings will be to <br />obscure the view of the proposed telecommunications facility and note that the property <br />owner has 30 days from receipt of the letter to respond. The letter shall of provide the <br />following three options and will specify that only one option can be chosen. <br />4) Please plant (max of 2) evergreen trees on the Oakway Golf Course within 10 feet of <br />my property line. <br />5) Please plant (max of 2) deciduous trees on the Oakway Golf Course within 10 feet of <br />my property line. <br />6) 1 do not want additional landscaping/trees to be planted within 10 feet of my property line. <br />Based on the response, the applicant will be required to plant the requested number of trees <br />on the site adjacent to the lot requesting the plantings. With written agreement from the <br />property owner the location and plantings can be adjusted. If the property owners do not <br />respond to the applicant in writing within 30 days of the mailing, the applicant will not be <br />required to provide additional trees along that lot boundary. <br />2. The final tree preservation/landscape plan (Sheet 1-1) shall show the location and species of <br />required new trees (proposed trees plus additional screening as requested by the neighbors) <br />to be planted on the development site. <br />• New trees to be planted on the development site shall be a minimum caliper of 2" for <br />deciduous trees and a minimum height of 6-feet for coniferous or evergreen trees at time of <br />planting. <br />• The proposed trees shall be planted a minimum of ten feet from structures and must be <br />located outside any easements. <br />• The plantings must be inspected and approved prior to the City granting final approval of the <br />building permit. <br />• A note shall be added to Sheet L-1 noting that "Watering and general maintenance of <br />replacement trees shall be conducted by the owner or lessee in a manner that ensures their <br />establishment and long-.term survival." <br />3. Tree Preservation Plan (Sheet L-1) with the final site plans shall include the following tree <br />preservation notes: <br />"All protective tree fencing shall remain in place until-completion of all construction activities." <br />"Protective fencing for trees identified to be preserved shall be inspected and approved by the <br />City prior to beginning any construction related activities. <br />"No excavation, grading, material storage, staging, vehicle parking or other construction <br />activity shall take place within the identified tree protection areas without approval by the <br />Staff Report <br />(PDT 10-2 & CU 11-1) June 2011 40 <br />Hp Agenda -Page 1 <br />
