I Appendix A <br />2 9.8090 Conditional Use Permit Approval Criteria - General. A conditional use <br />3 permit shall be granted only if the proposal conforms to all of the following <br />4 criteria: <br />5 (1) The proposal is consistent with applicable provisions of the Metro Plan <br />6 and applicable refinement plans. <br />7 (2) The location, size, design, and operating characteristics of the proposal <br />8 are reasonably compatible with and have minimal impact on the <br />9 livability or appropriate development of surrounding property, as they <br />10 relate to the following factors: <br />11 (a) The proposed building(s) mass and scale are physically suitable <br />12 for the type and density of use being proposed. <br />13 (b) The proposed structures, parking lots, outdoor use areas or <br />14 other site improvements which could cause substantial off-site <br />15 impacts such as noise, glare and odors are oriented away from <br />16 nearby residential uses and/or are adequately mitigated through <br />17 other design techniques, such as screening and increased <br />18 setbacks. <br />19 (c) If the proposal involves a residential use, the project is <br />20 designed, sited and/or adequately buffered to minimize off-site <br />21 impacts which could adversely affect the future residents of the <br />22 subject property. <br />23 (3) The location, design, and related features of the proposal provides a <br />24 convenient and functional living, working, shopping or civic <br />25 environment, and is as attractive as the nature of the use and its <br />26 location and setting warrant. <br />27 <br />28 9.8320 Tentative Planned Unit Development Approval Criteria- General. The <br />29 hearings official shall approve, approve with conditions, or deny a tentative <br />30 PUD application with findings and conclusions.
