To ensure removal of facilities comply with the criterion above, the following condition of <br />approval is warranted: <br />The following note shall be added to the final site plan "All transmission towers, <br />antennas, the tower substructure and all above ground ancillary facilities shall be <br />removed by the person who constructed the facility, by the person who operates the <br />facility, or by the property owner, within 6 months of the time that the facilities have <br />ceased being used to transmit, receive or relay voice and data signals to or from wireless <br />communication devices. The city manager may grant a 6-month extension where a <br />written request has been filed, within the initial 6-month period, to reuse the tower or <br />antennas". <br />As conditioned, the proposal will comply with this standard. <br />(11) Application Review and Fees. The city manager shall retain one or more <br />consultants to verify the accuracy of statements made in connection with an <br />application for a building or land use permit for a telecommunications facility. <br />Notwithstanding any other provision of this code, the city manager shall <br />require the applicant to pay, as part of the application fees, an amount <br />sufficient to recover all of the city's costs in retaining the consultant(s). <br />Carl Bloom of Environalysis LLC was retained to verify the accuracy of statements made in <br />connection with both the PUD and CUP applications, including verifying the accuracy of the <br />noise reports and emissions reports. Additionally he also reviewed the accuracy of statements <br />AT&T provided regarding the limitations of stealth.design. The applicant has been billed and <br />paid for these services. As such this standard is met. <br />EC 9.8320(12): The proposed development shall have minimal off-site impacts, <br />including impacts such as traffic, noise, stormwater runoff and environmental quality. <br />Extensive public testimony from neighbors was received regarding the negative off-site impacts <br />of the development. The concerns were primarily related to RF emission concerns and aesthetic <br />concerns of a 75-foot tower located near their houses. These concerns are discussed below. <br />Traffic - As noted above at EC 9.8320(5)(c),with a projected increase in traffic limited to one <br />visit per month, utilizing the existing driveway, the proposed cell tower facility will have <br />minimal off-site impacts in regards to traffic. <br />Noise - Noise was fully discussed in response to EC 9.5750 (7)(f) (the telecommunications <br />requirements).
