1Planning <br />NOTICE HEARINGS OFFICIAL DECISION <br />May 21, 2015 <br />On November 12, 2013, the Eugene Hearings Official approved a Planned Unit Development (City File No. PDT- <br />13-1; City File Name: Oakleigh Meadows Cohousing PUD). Notice of the decision was sent out to interested <br />parties on November 12, 2013. Copies of that decision and notice are attached to this letter. Interested <br />neighbors filed a local appeal of the Hearings Official's decision to the Eugene Planning Commission, which <br />subsequently affirmed the Hearings Official approval, with some modified conditions. <br />Although you submitted written comments to the Hearings Official (letter dated September 1, 2013), you were <br />inadvertently omitted from the list of those sent notice of the decision and notice of the planning commission's <br />local appeal hearing. The Land Use Board of Appeals (LUBA) determined that the procedural error on the part of <br />the City prejudiced your substantial rights and LUBA, therefore, remanded the matter to the City. <br />If the City had provided you with notice of the Hearings Official decision, you would have had an opportunity to <br />file an appeal of the Hearings Official decision to the Planning Commission. Accordingly, this Notice of decision <br />begins the time period for you to file a local appeal of that Hearings official decision. Attached to this letter is <br />the appeal form for filing such appeal. The fee of an appeal of a Hearings Official decision in this matter is <br />$8,875.33, which represents 50% of the initial application fee. See fee schedule attached hereto. Pursuant to <br />Eugene Code 9.7655, your appeal must be received by the City no later than 5:00 p.m. of the 12th day after the <br />Notice of Decision is mailed.
