multiple facilities that are of a lesser height than the proposed 75-ft monopine. This is the only <br />way to avoid the inherent disruption caused by the negative visual impact from the monopine on <br />the surrounding area. Clearly, the design of the tower is not compatible with the setting of the <br />neighborhood, which warrants a more attractive proposal. The proposed tower is, therefore, not <br />as attractive as the nature of the use and its location and setting warrant, and the tower does not <br />preserve and enhance the character of the neighborhood, parklands, running trails, and Amazon <br />creek. Instead, the proposal only increases visual blight on surrounding properties and uses. <br /> <br />Expansion of a nonconforming use <br />type of nonconforming use, nor may any legal nonconforming use be <br />Here, the existing church is considered a non-conforming use in that it does not have an <br />approved conditional use permit, which is required for churches in the R-1 zone. While the <br />church itself is not expanded, the facilities building is intended to look like the church, and, <br />therefore, the property is expanding structures associated with the church for commercial uses. <br />Furthermore, the telecommunications use is directly benefitting the church, and, therefore, the <br />church is expanding its use by leasing property to the applicant. The church has expanded its use <br />of the property for church purposes to purposes never previously used. See exhibit Z (comment <br />on nonconforming use). The newly expanded use materializes itself in a 75-ft tower and <br />ancillary facilities, and, therefore, the applicant has lost its nonconforming use status. Because <br />the nonconforming use will be lost, the property is subject to residential use, and, therefore, the <br />property cannot have a telecommunications facility sited in an R-1 zone where there are <br />residential uses, pursuant to 9.5750(g). <br /> <br />Conclusion <br /> For the foregoing reasons, Friends of Amazon Creek respectfully requests that the <br />application be denied. <br /> <br /> <br /> <br /> <br /> <br /> <br />23 <br /> <br />
