<br />(d) Street Trees. If the proposal includes removal of any street tree(s), removal of <br />those street tree(s) has been approved, or approved with conditions according <br />to the process at EC 6.305 of this code. <br />Since the proposal does not involve the removal of trees located within existing public rights-of- <br />way, this criterion is not applicable. <br /> <br />EC 9.8090(6): The proposal provides adequate public facilities and services including, <br />but not limited to utilities, streets, and other infrastructure. <br />Referral comments from Public Works staff confirm that although no public improvements are <br />proposed, the existing street system and public utilities can adequately serve the proposed <br />development based on compliance with EC 9.8090(8)(b), (8)(d) and (8)(e). <br />EC 9.8090(7): The proposal does not create any significant risk to public health and <br />safety, including but not limited to soil erosion and flood hazard, or an impediment to <br />emergency response. <br /> <br />The previous findings related to RF exposure are incorporated herein by reference. To the <br />extent that the applicant has demonstrated compliance with applicable federal standards for RF <br />emissions, the City does not have the authority to further address potential health effects of <br />the proposed facility as addressed extensively in opposing testimony. Referral comments from <br />Public Works and the Fire Marshal’s Office staff do not raise any additional concerns or <br />requirements related to this criterion. As such, this criterion is met. <br /> <br />EC 9.8090(8): The proposal complies with all applicable standards, including but not <br />limited to: <br /> <br />(a)EC 9.2000 through 9.3915 regarding lot dimensions, solar standards, and <br />density requirements for the subject zone; <br />As this proposal does not include any land division or residential building, lot dimension, solar <br />lot standards and density requirements are not applicable. <br />(b)EC9.6500 through EC 9.6505 Public Improvement Standards; <br />No additional public improvements, easements, water supply, sewage, streets and alleys, <br />sidewalks, bicycle path or public accessways are required for this proposal. <br />(c)EC 9.6735 Public Access Required; <br />The subject property has existing access to Fox Hollow Road and West Amazon Drive, which are <br />both public streets. With an anticipated increase in traffic of only one trip per month, the <br />existing access connections are exempt from additional review under access management <br />HO Agenda - Page 18 <br />
