Install sound absorbing material on the walls and ceiling of the generator room; <br />Install a sheet metal hoods with 1” duct liner on the outside air intake and air exhaust <br />openings; <br />Install an exhaust stack muffler on the generator engine exhaust stack. <br /> <br />With these mitigation measures in place, the analysis shows that typical daily operation of the <br />facility will be at orbelowthe 45dBathreshold required by code. During a power failure when <br />the emergency generator is operational, the combined sound level of the generator and air <br />conditioning units is predicted to be approximately 45dBa at the receiving properties to the <br />west and the south. Also, once per month, a ten minute generator test must be conducted, <br />which is assumed to also generate 45dBa of sound at receiving property lines. Based on the <br />acoustical analysis, the facility is predicted to be at the maximum permissible sound level at <br />neighboring residential properties once a month and during power outages. <br /> <br />Staff is concerned that since this analysis is only predictive, the sound levels associated with this <br />proposal can only be assessed once the facility is completed and functional. If the proposal is <br />ultimately approved and the facility is constructed, authorized City staff will have to monitor <br />the sound levels to determine compliance with the code. If the facility is found to operate out <br />of compliance, the applicant will be required to install additional mitigation measures to ensure <br />compliance. If additional mitigation measures cannot be found to bring the facility into <br />compliance, the City may find the facility is non-complaint with this section of the code and <br />possibly issue civil penalties, require corrective action to mitigate the noise, or potentially even <br />revoke the CUP if the violation is not remedied. <br /> <br />In the event of an approval, staff would recommend conditions to require the applicant to <br />conduct on-site sound level testing at all receiving property lines, to provide evidence of <br />compliance upon construction of the facility, and to explicitly ensure that the facility would not <br />be allowed to exceed the 45dBa standard at any time. However, for the reasons discussed <br />above regarding visual impact, the proposal does not meet the approval criteria at EC <br />9.8090(2)(b). <br /> <br />(c)If the proposal involves a residential use, the project is designed, sited and/or <br />adequately buffered to minimize off-site impacts which could adversely affect the <br />future residents of the subject property. <br /> <br />This criterion does not apply, as the proposed telecommunications facility does not include <br />residential use. <br /> <br />EC 9.8090(3): The location, design, and related features of the proposal provides a <br />convenient and functional living, working, shopping or civic environment, and is as <br />attractive as the nature of the use and its location and setting warrant. <br />This subsection of the code relates to the nature of the proposed use and its functionality with <br />the location and setting. The location and design of the proposed cell tower is such that it will <br />have minimal impact on the remainder of the site. The use should have no direct impact on the <br />HO Agenda - Page 15 <br />
