In the event of inconsistencies between these plans and the Metro Plan, the Metro <br />Plan controls. <br /> <br />The entire subject area is being removed from the applicable adopted refinement plan area, as <br />discussed above. Therefore, the above criterion is inapplicable. <br />EC 9.8865(3): The uses and density that will be allowed by the proposed zoning in the <br />location of the proposed change can be served through the orderly extension of key urban <br />facilities and services. <br /> <br />The subject area is currently served with a full range of key urban services and facilities as defined in <br />the Metro Plan. The findings of compliance with Goal 11 – Public Facilities and Services, and Goal 12 <br />– Transportation above, also are incorporated herein by reference. With the findings established and <br />referenced herein, the proposal complies with this criterion. <br />EC 9.8865(4):The proposed zone change is consistent with the applicable siting <br />requirements set out for the specific zone in… <br /> <br />In this case, the proposed code amendments will include newly adopted siting requirements for the <br />S-SW zone. Those proposed siting requirements at EC 9.3834 state that that the site must be <br />included within the South Willamette area as depicted on Figure 9.3832 S-SW Regulating Plan – <br />Subdistricts and Overlay Subdistricts, and further, that the S-SW zone including subdistricts and <br />overlays shall remain in place until or unless the code is amended to facilitate rezoning in accordance <br />applicable adopted plan designations at that time. <br /> <br />As demonstrated by the maps and tables provided as Attachment A, which are consistent with Figure <br />9.3832 S-SW Regulating Plan – Subdistricts and Overlay Subdistrictsin Attachment B, the proposed <br />zone changes comply with the proposed siting requirements for the S-SW zone and this criterion is <br />met. <br /> <br />EC 9.8865(5): In cases where the NR zone is applied based on EC 9.2510(3), the property <br />owner shall enter into a contractual arrangement with the city to ensure the area is <br />maintained as a natural resource area for a minimum of 50 years. <br /> <br />The NR zone is not requested or applicable in this instance.
