FIRST ASSIGNMENT OF ERROR <br />The Decision erred by finding the application met the following approval <br />criterion: <br />EC 9.8320(1) The PUD is consistent with applicable adopted policies of <br />the Metro Plan. <br />The Metro Plan "Transportation Element" states: <br />F. Transportation Element <br />The Transportation Element addresses surface and air transportation in <br />the metropolitan area. The Eugene-Springfield Metropolitan Area <br />Transportation Plan (TransPlan) provides the basis for the surface <br />transportation portions of this element and the Eugene Airport Master Plan <br />provides the basis for the air transportation portions. <br />Goals and policies in TransPlan are contained in this Transportation <br />Element and are part of the adopted Metro Plan. TransPlan project lists and <br />project maps are also adopted as part of the Metro Plan. (Metro Plan III-F-1) <br />The following subassignments of error individually and in combination <br />resulted in the erroneous finding that the application was consistent with the <br />Metro Plan. <br />Whether or not the two unexamined policies, discussed below, are <br />mandatory approval criteria, the Hearings Official was required to evaluate <br />and balance relevant plan provisions in his findings and decision, which he <br />failed to do. Bothman v. City of Eugene, Or LUBA 701 (2006). He also failed to <br />consider these policies as relevant context for his findings in regards to the <br />specific approval criteria covered below. <br />See Conte 10/9 pages 3 to 4. <br />SUBASSIGNMENT OF ERROR 1.A <br />The Decision failed to address the following policy at all: <br />TransPlan Transportation System Improvements (TSI) Pedestrian <br />Policy #1: Pedestrian Environment (Metro Plan Policy F.26) <br />Provide for a pedestrian environment that is well integrated with <br />adjacent land uses and is designed to enhance the safety, comfort, and <br />convenience of walking.
